Terms of Service

These Terms of Service govern your access to and use of services provided by PropAnalytics (with our affiliates and subsidiaries, "PropAnalytics," "we," or "us"). By creating an account, accepting these terms, starting a trial, purchasing a subscription, or using the service, you agree to these terms, the Privacy Policy, the Refund and Cancellation Policy and the terms of any applicable Subscription Agreement.

If you use PropAnalytics for a company, firm, or other organization, you represent that you are authorized to accept these terms on your and its behalf. Pilot confidentiality agreements remain separate agreements and are not replaced by these customer terms.

PropAnalytics provides software tools for organizing comparable sales, retrieving assessed-value information where available, reviewing valuation-support data, and generating PDF reports (collectively, the "Service").

You are responsible for the data you upload, the assumptions you make, and the final professional judgment applied to any report or analysis generated with the Service.

PropAnalytics and its software, source code, interfaces, designs, documentation, training materials, branding, and other original content are owned by PropAnalytics or its licensors and are protected by applicable intellectual-property laws.

Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, personal, revocable license to use the Service during the applicable service term (as may be identified in an applicable Subscription Agreement) for your own internal professional purposes. No ownership rights are transferred to you.

You may use reports you generate for legitimate client and professional work and distribute the same to individual clients. You may not copy, sell, sublicense, publish, create derivative works of, publicly reproduce, reverse engineer, or scrape the Service or any portion or output thereof, and you may not create a service that competes with PropAnalytics.

You retain your rights in the files, property information, client details, logos, and other content you submit to or as part of the Service ("Customer Data"). You grant PropAnalytics the non-exclusive, perpetual, irrevocable, transferable, and royalty-free right to use Customer Data for our own necessary and useful lawful business purposes, including (a) to host, process, transmit, reproduce, and format content as needed to provide, secure, support, and improve the Service, (b) troubleshooting and debugging to identify and repair errors that impair existing intended functionality in the Service, and (c) transferring anonymous Customer Data to third-party business partners domestically and internationally.

We shall own information generated by, outputted from, or otherwise produced during or through the use of the Service ("Usage Data"). To the extent you retain any right, title, or interest in and to such Usage Data, you hereby grant us a non-exclusive, perpetual, irrevocable, transferable, and royalty-free license to create and use Usage Data, including to compile statistical and performance information related to the provision and operation of the Service, for any and all purposes that are necessary or useful to us, our affiliates, our subcontractors, or our third-party partners, including to: (a) build or improve the quality of our products and services; (b) prevent, detect, or investigate data security incidents or protect against malicious, deceptive, fraudulent, or illegal activity; (c) comply with federal, state, or local laws, or comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, court order, or summons by federal, state, or local authorities; and (d) exercise or defend legal claims.

To the extent Customer Data and/or Usage Data is your confidential information, you agree that we may use such information internally, and disclose to third parties on a confidential basis, to provide the Service and to the full extent useful to exploit the licenses set forth herein. Without limiting the foregoing, you agree that we may use Customer Data and/or Usage Data in an aggregated manner to publicly market and advertise the Service.

You represent that you have the rights and professional authority needed to submit and use the information you provide and to provide the licenses contemplated herein. Do not upload Social Security numbers, full payment-card numbers, financial-account credentials, health information, or other sensitive information that is unnecessary for the Service.

You are responsible for reviewing results, correcting errors, maintaining appropriate source documentation, and deciding whether a generated report is suitable for its intended use.

PropAnalytics is not an appraisal, automated valuation model, legal opinion, tax opinion, or substitute for professional review. The Service is intended to support analysis, not replace it.

Reports, charts, ratios, FHFA HPI references, and county lookup results should be independently reviewed before being relied upon or shared with clients, courts, lenders, agencies, or other third parties.

Some features depend on third-party websites, public records, county systems, FHFA data, Stripe, Clerk, Vercel, Railway, and other infrastructure providers.

We do not control third-party sources and cannot guarantee that lookup data will always be available, complete, accurate, current, or formatted consistently.

You are responsible for maintaining the security of your account and for all activity that occurs under your login.

Paid access is managed through Stripe. Before checkout, we disclose the selected price, billing interval, applicable trial or delayed start date, and automatic-renewal terms. Your subscription renews at the disclosed interval until canceled.

You may cancel through the Stripe customer portal from the Billing page. Unless otherwise stated at checkout, cancellation stops future renewals and access continues through the paid billing period. Trial, refund, founding-rate, and cancellation details are also described in the Refund and Cancellation Policy.

You are responsible for applicable taxes, except taxes based on our net income. Features may be limited, suspended, or unavailable if payment fails, a subscription is canceled, or account access is terminated.

You agree not to misuse the Service, interfere with its operation, attempt unauthorized access, upload unlawful materials, or use the Service in a way that violates applicable laws or third-party rights.

We may restrict or terminate access if use of the Service creates security, operational, legal, or reputational risk.

You may not share accounts, probe or bypass access controls, introduce malicious code, overload the Service, misrepresent generated work, infringe intellectual-property or privacy rights, or use data obtained through the Service for unlawful discrimination or other unlawful purposes.

We may suspend or terminate access for material violations of these terms, nonpayment, fraud, security threats, unlawful conduct, or activity that threatens the Service or others. When reasonably practical, we will provide notice and an opportunity to resolve the issue.

You may stop using the Service at any time and may cancel recurring billing through the customer portal. Provisions concerning ownership, payment obligations, disclaimers, liability, indemnification, and records that reasonably must survive will continue after termination.

To the fullest extent permitted by law, the Service is provided as-is and as-available. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant uninterrupted operation or error-free results.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

We are not liable for lost profits, business interruption, inaccurate third-party data, professional errors, report conclusions, or indirect, incidental, consequential, special, or punitive damages arising from use of the Service.

To the fullest extent permitted by law, the total liability of PropAnalytics arising from or relating to the Service will not exceed the greater of one hundred dollars or the amount you paid to PropAnalytics during the twelve months before the event giving rise to the claim. This limitation does not apply where prohibited by law.

To the extent permitted by law, you agree to defend and indemnify PropAnalytics from third-party claims, damages, and reasonable costs arising from your uploaded content, unlawful use, professional conclusions, violation of these terms, or infringement of another person's rights.

Any testimonials you may provide are done so on a voluntary basis. By providing a testimonial, you provide us an express perpetual and irrevocable license to use your testimonial and your name, and to attribute your testimonial to you, for our business purposes, including to publicly market and advertise the Service. In consideration for such use, we shall provide access to the Service for a period of one (1) month.

The Service may use machine learning, deep learning, and other artificial intelligence ("AI") technologies, including statistical learning algorithms, models (including large language models), neural networks, and other AI tools or methodologies, and any software implementations of the foregoing, and related hardware equipment, which may be capable of generating various types of content, including text, images, video, audio, or computer code based on user-supplied prompts (collectively, "AI Technology"). You agree and accept our use of AI Technology in connection with providing the Service.

We may update these terms, the Privacy Policy, the Refund and Cancellation Policy, or the terms of any applicable Subscription Agreement from time to time. We will post an updated effective date and provide notice to you when a material change warrants it. Continued use of the Service thereafter is your express assent to such changes. Changes do not retroactively alter charges already paid or rights that accrued before the change.
